- IN GENERAL
Grain Weevil Corporation, a Delaware C-corporation operating in the state of Nebraska (“we,” “us,” or “Grain Weevil”), values our customers and respects their privacy. This Privacy Policy (“Privacy Policy”) governs our collection and use of data in connection with the Grain Weevil companion mobile application (the “App”) and any related services provided directly through the App (collectively, the “Services”). Terms capitalized but not defined in this Privacy Policy have the meaning given to them in our Terms of Use.
This Privacy Policy applies only to the App. It does not apply to grainweevil.com or any other Grain Weevil website, which are instead governed by our separate Website Privacy Policy. If you have questions about our website’s data practices, please refer to that policy rather than this one.
This Privacy Policy sets forth the nature, purpose, use, and sharing of any information that identifies or can be used to identify you (“Personal Information”). This Privacy Policy does not govern privacy practices associated with offline activities, websites other than ours, or the practices of third parties that we do not own or control. If you have objections to this Privacy Policy, you should discontinue use of the Services and contact us using the information in the “Contact Us” section below.
The App is not directed to children and is not intended for use by anyone under the age of 16. We do not knowingly collect Personal Information from anyone under age 16. If we learn that we have inadvertently collected Personal Information from a child under 16, we will delete that information as quickly as possible. If you believe we might have any Personal Information from a child under 16, please contact us immediately using the information below.
- CHANGES TO THIS PRIVACY POLICY
Any Personal Information that we collect and maintain will be subject to this Privacy Policy, as amended from time to time. We may change this Privacy Policy at our sole discretion. If we make material changes, we will notify you by updating the “Effective Date” above and, where appropriate, through the App or our website.
- CAMERA, PHOTOS, AND VIDEO
The App does not access or use your mobile device’s camera. Instead, the Grain Weevil robot is equipped with its own onboard camera(s), which the App uses solely to provide local, real-time video streaming between the robot and your device. This functionality exists to support the safe operation and monitoring of the robot while it is in use inside a grain bin.
- Photos and video captured through the App are stored only locally on your device.
- We do not upload, transmit, or otherwise store your photos or videos on our servers.
- We do not share, sell, or provide access to your photos or videos to any third party.
- We do not access, view, or retain any photos or videos that you capture or store on your device.
- CONNECTIVITY
The App connects to the Grain Weevil receiver unit through a direct, wired Ethernet cable connection between your device and the receiver. This connection does not provide or require access to the internet. The receiver unit separately communicates with the robot using a proprietary peer-to-peer wireless connection between Grain Weevil hardware components; this wireless link does not involve, pass through, or make use of your device’s own Wi-Fi, Bluetooth, or cellular radios. Because the App does not use your device’s wireless radios to connect to Grain Weevil hardware, connecting to the robot does not require your device to grant Wi-Fi, Bluetooth, or location permissions.
- OUR APPROACH TO DATA COLLECTION
The App does not collect, store, or transmit any Personal Information, and we do not engage in advertising of any kind through the App. We do not use cookies, web beacons, software development kits (SDKs), advertising identifiers, or analytics tools that track you across other companies’ apps or websites. If this changes in the future, we will update this Privacy Policy accordingly and, where required, provide additional notice.
- DISCLOSURE TO THIRD PARTIES
Because we do not collect Personal Information through the App, we have no Personal Information to sell, share, or otherwise disclose to third parties in the ordinary course of business. We may disclose information as required by law, regulation, subpoena, or governmental order, or as necessary to protect the rights, property, or safety of Grain Weevil, our users, or others. We do not use third-party analytics, advertising, tracking, or data-collection SDKs within the App. If we engage a service provider in the future that processes Personal Information on our behalf, we will require that provider to maintain protections for such information consistent with this Privacy Policy and applicable law. If Grain Weevil is involved in a merger, acquisition, or sale of all or substantially all of its assets, information may be transferred as part of that transaction, subject to this Privacy Policy.
- YOUR CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)
Grain Weevil does not sell or share Personal Information, as those terms are defined under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (“CCPA”). Because the App does not collect Personal Information, there is generally no Personal Information for us to provide, correct, or delete in response to a CCPA request. If you are a California resident and have questions about our data practices, you may contact us using the information in the “Contact Us” section below, and we will respond consistent with our obligations under the CCPA.
- INTERNATIONAL AVAILABILITY
The App is made available for download and use internationally. Grain Weevil does not collect or process Personal Information through the App as described in this Privacy Policy. If our data practices change, we will update this Privacy Policy and comply with applicable privacy laws.
- DATA RETENTION
We do not collect or store Personal Information off of your device, so we do not maintain a retention schedule for such information. Any photos or videos captured through the App remain on your device under your own control, and you may delete them at any time using your device’s standard photo, video, or file-management controls.
- PROTECTION OF INFORMATION
Although the App does not collect Personal Information, we use reasonable technical and organizational security measures, including encryption and authentication tools where applicable, to help protect the App and its functionality. If we learn of a security issue affecting the App, we will take appropriate steps and notify affected users as required by applicable law.
- YOUR CHOICES
Because the App does not collect Personal Information, there is generally no account data or marketing profile for you to opt out of. If you have general questions about your privacy or this Privacy Policy, you may contact us at any time using the information in the “Contact Us” section below.
- GOVERNING LAW
The terms of this Privacy Policy are governed by and construed in accordance with the laws of the State of Nebraska and, where applicable, United States federal law, without regard to conflict-of-law principles.
